Terms of Sale
DEFINITION AND SCOPE OF THE CONTRACT
This is a distance contract in compliance with art. 50 et seq. of Legislative Degree no. 206 of 6th September 2005 (“Consumer Code”). The scope of the contract is the sale of movables between Porciatti L. & A. snc., with registered office in Radda in Chianti, Piazza 4 Novembre 1, Tax Code/VAT No. 00655330520, Siena Business Register No. 00655330520, and the Customer. The Contract is executed directly through the acceptance by Porciatti L. & A. snc of a purchase order placed by the Customer by telephone or through the website www.casaporciatti.it and/or through other distance sales systems.
PRICES AND AVAILABILITY OF THE GOODS
Prices of the goods include VAT.
Some items may be subject to limited availability. For this reason, acceptance by Casa Porciatti of the purchase order submitted by the Customer depends on whether the items requested are in stock. Casa Porciatti undertakes to immediately notify the Customer of unforeseeable stock shortages resulting from excessive demand or other reasons.
Casa Porciatti reserves the right to refuse the sale and notify the refusal to the Customer within 10 days of receipt of the order.
GOODS DELIVERY – CLAIMS
Casa Porciatti delivers the goods to the address indicated by the Customer, within 30 (thirty) days of the execution of the Contract.
The contract is considered executed once payment is made.

On delivery, the Customer is requested to check:
- that the packaging is in good condition, not damaged, not wet, and compliant with normal packaging standards
- – that the number of boxes delivered is the same as the number stated on the waybill.
By signing the delivery documents, the Customer accepts the goods delivered without reservation.
Claims, if any, shall be lodged immediately with the carrier; failing these, the goods shall be deemed duly delivered; please keep all documents contained in the packaging.
Complaints about the shipped goods should be lodged firstly with the carrier who made the delivery, by calling – if possible – a toll free number or any other number made available to the Customer, or by going to the closest office. Subsequently, the complaint should be notified by email to ecommerce@casaporciatti.it or by fax at +39(0577)738055, complete with photo(s), and reporting the date and time of delivery and the reference number of the file opened by the carrier who made the delivery.
Claims lodged more that 5 days after receipt of the goods shall not be accepted.
If the goods show visible signs of damage (broken boxes, wine leaks, etc.) at the time of delivery by the carrier, it is advisable to refuse them.
Casa Porciatti shall make a new shipment of undamaged products.
In case of delivery of several packages, it shall be sufficient to refuse only the package containing the damaged goods, stating “with reservation” on the delivery note.
Casa Porciatti shall replace only the damaged goods.
INFORMATION ON THE RIGHT OF CANCELLATION
The right to cancel may be exercised, within the established cancellation period, by giving a notice of the cancellation in writing to the following address: Porciatti L. & A. snc – 53017 Radda in Chianti (SI), Piazza IV Novembre, 1.
The right to cancel can be exercised within 10 working days of the receipt of the goods (art. 65, par. 2, letter a). The right to cancel is respected when Porciatti L. & A. snc receives the Customer’s notice of cancellation within the cancellation period stated above. The notice shall be given by registered letter with acknowledgement of receipt, by fax at +39(0577)738234 followed by a confirmation sent by registered letter within 48 hours of the fax, or by email to ecommerce@casaporciatti.it
The goods received shall be returned to the following address: Porciatti L. & A. snc – Piazza 4 Novembre 1, 53017 Radda in Chianti (SI) within 15 working days of receipt of the goods.
Shipping costs shall be borne by the Customer.
CUSTOMER’S OBLIGATIONS
The Customer declares and guarantees: (i) to be a consumer in compliance with the provisions of art. 3 of the Consumer Code; (ii) to be of full age; (iii) that the data provided by him/her for the execution of the Contract are true and correct.
RIGHT OF CANCELLATION
The Customer is entitled to cancel the contract entered into, without penalty and without the need to state the reason(s) for the cancellation, within 10 days of the receipt of the goods.
The Customer may exercise the right to cancel within the cancellation period stated above, by giving written notice thereof to the registered office of Casa Porciatti, to be sent by registered letter with acknowledgement of receipt, by telegram or by email.
The Customer who wishes to exercise the right to cancel shall return the goods to the address stated on the invoice, following the instructions stated therein, within 15 days of receipt of the goods. Pursuant to art. 55, par. 2 of the Consumer Code, the Customer shall not be entitled to cancel in the following circumstances:
– supply of custom-made or personalised goods or of goods that, because of their nature, cannot be returned or risk to deteriorate or spoil rapidly (e.g. food products);
Return costs are at the Customer’s charge. Casa Porciatti shall reimburse, within 30 days of the date of receipt of the goods from the Customer:(i) the total price paid by the Customer if the product is returned unopened; or (ii) the fraction of the price equivalent to the amount of goods actually returned by the Customer in case the latter has made use of it in a substantial matter and/or in such a manner as to diminish its value.
Goods shall be returned in their original packaging and suitably packed to prevent damage during transportation.
JURISDICTION AND COMPETENT COURT
For any and all disputes arising from these General Conditions and sales contracts concluded on the basis of the same, the exclusive jurisdiction will be that of Italy and the jurisdiction will belong exclusively to the Court of Siena.
